If Eliot had declined to defend the state, NY would have had to hire private attorneys instead. (This is considered appropriate for an AG to do only in the most extreme of circumstances.) It would have cost the taxpayers a fortune, and Tom Suozzi would be railing against Spitzer for being profligate.
